Terms of Service — Palmy Clothing

These Terms of Service (“Terms”) govern your access to and use of Palmy Clothing websites, chat, and services (collectively, the “Services”). By using the Services, you agree to these Terms.
1) Who we are
“Palmy,” “we,” “our,” or “us” means Palmy Clothing [legal entity & registration number, if any].

2) Eligibility & accounts

You must be able to form a legally binding contract and comply with applicable laws.

You’re responsible for keeping your account details (including delivery address and measurements) accurate and secure.
3) Orders & made-to-order production

Made to order only. Every Palmy piece is tailored to your submitted measurements after purchase; we do not keep ready stock.

No cancellations. Production begins shortly after payment; orders cannot be cancelled. If you need an urgent edit (measurement, color, address), contact WhatsApp immediately; changes are not guaranteed once cutting/production starts.

Measurement responsibility. You are responsible for providing accurate measurements. Minor production tolerances may apply due to fabric and construction (e.g., small variances typical to apparel).

Color/appearance. We aim for accurate photos, but minor color variations may occur due to lighting and device displays.
4) Pricing, currency & payments

Prices are listed in KWD unless stated otherwise. Your card issuer may apply foreign exchange or bank fees.

We accept KNET, Visa, Mastercard. By submitting a payment, you authorize us to charge the full order total (including applicable surcharges).

We may correct pricing errors and cancel/refund orders affected by errors or suspected fraud/abuse.
5) Shipping & delivery

Kuwait (Standard): 7–12 business days from order to delivery.

Kuwait (Fast Execution): ~3 business days (capacity-limited; availability and surcharge shown at checkout).

Outside Kuwait (International): within 10 business days, destination-dependent.

Free shipping: Orders ≥ 60 KWD. Orders under 60 KWD show fees at checkout.

Business days are Sun–Thu (Kuwait). Public holidays and peak periods may extend timelines.

You’ll receive tracking once shipped. If tracking shows no movement for 48 hours, contact us.

If a parcel is marked delivered but not received, check with building/security/neighbours, then contact us within 48 hours for a carrier trace. Re-delivery fees may apply for incorrect addresses or missed delivery attempts.

International duties & taxes: Recipients are responsible for any local VAT/duties and customs clearance.
6) No returns / no exchanges

Because each item is custom-made to your specifications, we do not accept returns or exchanges for preference, fit selection, or inaccurate measurements provided by the customer. This does not affect any non-waivable consumer rights under applicable law.
7) Quality guarantee (defects only)

Our quality guarantee covers material or craftsmanship defects relative to the measurements you submitted.

To make a claim, message WhatsApp +965 55164627 within 7 days of delivery with: order number, photos/video, and a description of the issue.

If we confirm a covered defect, our remedy is repair or remake (at our cost). This guarantee does not cover normal wear, misuse, laundering damage, accidental damage, or preference-based requests.
8) Promotions & discount codes (including “Palmy15”)

From time to time we may offer promotions or codes such as “Palmy15”. Unless stated otherwise:

Single-use, non-transferable, non-stackable, and may exclude surcharges (e.g., Fast Execution).

Time-limited and subject to change or withdrawal at any time.

Not redeemable for cash; not valid on previous purchases.

We may decline, revoke, or adjust a promotion in cases of misuse, abuse, or technical error.
9) User content (reviews, photos, messages)

If you submit content (e.g., reviews, photos, messages), you represent it is truthful, lawful, and your own.

You grant Palmy a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for marketing, advertising, and improvement of the Services.

We may moderate or remove content that is unlawful, misleading, or violates these Terms.
10) Acceptable use
You agree not to:

Misrepresent identity, order for resale without permission, or engage in fraud or chargeback abuse;

Interfere with site security, scrape/crawl without consent, or misuse our IP;

Upload unlawful, defamatory, or infringing material.
11) Intellectual property
All content, designs, trademarks, and logos on the Services are owned by or licensed to Palmy and protected by law. You may not use our IP without prior written consent.
12) Third-party services
We may use third-party couriers, payments, or integrations. Their terms and privacy practices apply to those services.
13) Limitation of liability
To the maximum extent permitted by law, Palmy and its officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Services or products, even if advised of the possibility. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
14) Warranties disclaimer
Except for the Quality Guarantee in Section 7 and any rights that cannot be excluded under applicable law, the Services and products are provided “as is” without warranties of any kind (express or implied), including fitness for a particular purpose and merchantability.
15) Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including but not limited to supply disruptions, customs delays, weather, labor issues, or carrier failures.
16) Privacy
Your use of the Services is also governed by our Privacy Policy [link]. By using the Services, you consent to our collection and use of personal data as described there.
17) Governing law & disputes
These Terms are governed by the laws of the State of Kuwait, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the courts of Kuwait City, Kuwait. Nothing prevents either party from seeking urgent injunctive or equitable relief.
18) Changes to the Services or Terms
We may update the Services or these Terms from time to time. Updates take effect when posted on our site with a new “Last updated” date. Continued use of the Services after changes means you accept the updated Terms.
19) Severability & assignment
If any provision is found unenforceable, the remaining provisions remain in full force. You may not assign your rights under these Terms without our consent; we may assign to an affiliate or successor.
